User Agreement for Media2Text by Babay

Effective Date: March 1, 2026
Developer (Service Owner/Data Controller): Babay (pseudonym) — private individual, resident of the Republic of Kazakhstan, member of the Journalists' Union of Kazakhstan.

1. GENERAL PROVISIONS

1.1. This User Agreement (hereinafter the "Agreement") governs the relationship between the owner of the Media2Text service (hereinafter the "Service") and the user (hereinafter "You") regarding media transcription services.

1.2. By using the Service, You confirm that You:

  • Are at least 16 years of age;
  • Have read and understood the terms of this Media2Text "User Agreement";
  • Have read and understood the Media2Text "Privacy Policy";
  • Accept all terms of the "Privacy Policy" and "User Agreement" voluntarily, knowingly, and in full.

1.3. The Service provides automated transcription of audio and video recordings into text using Artificial Intelligence (a fine-tuned OpenAI Whisper model).

2. TERMS OF USE

2.1. Content Warranties: You warrant that the files uploaded for transcription:

  • Do not infringe upon the intellectual property or copyrights of third parties;
  • Do not contain illegal content;
  • Do not violate applicable laws.

2.2. Prohibited Activities: You agree not to use the Service for:

  • Distributing extremist materials;
  • Promoting violence or discrimination;
  • Violating personal data protection laws;
  • Any other illegal purposes.

2.3. The Service reserves the right to refuse service if these terms are violated.

3. PRIVACY AND DATA PROCESSING

3.1. Personal data processing is governed strictly by the Service’s "Privacy Policy."

3.2. By using the Service, You agree to the "Privacy Policy." Data processing is carried out in accordance with the GDPR, primarily based on the performance of a contract (Article 6(1)(b)) and, where applicable, user consent (Article 7).

4. INTELLECTUAL PROPERTY

4.1. All rights to the software, design, and proprietary technology of the Service belong to the Owner.

4.2. All rights to your original media files and the resulting transcription text remain with the respective rightsholder (You).

4.3. Transcriptions are provided to You for your use. You carry full responsibility for the legal compliance of how You use these results.

5. QUALITY OF SERVICE AND LIMITATION OF LIABILITY

5.1. Transcription quality depends on objective factors:

  • Quality of the original recording;
  • Background noise levels;
  • Speech clarity and accents.

5.2. The Service does not guarantee 100% accuracy. We strongly recommend verifying the results before using them for professional or critical purposes.

5.3. Liability: To the extent permitted by applicable law, the Service is not liable for:

  • Consequences arising from the use of transcription results;
  • Lost profits or indirect damages;
  • Misuse of the Service by third parties.

6. SERVICE PLANS

6.1. Tiers: The Service offers the following plans:

  • Free (Guest): Limited transcription volume.
  • Standard: 450 minutes per 30 days.
  • Pro: 1,350 minutes per 30 days.
  • Freedom: Prepaid (Pay-as-you-go) balance.

6.2. Payments: All payments are processed through systems integrated with the Google Play Store.

6.3. Refunds: Refunds are handled in accordance with Google Play Store policies and regulations.

7. TERMINATION

7.1. You may stop using the Service at any time.

7.2. The Owner reserves the right to suspend or terminate access if these terms are breached.

7.3. Data Erasure: Upon termination, your data is deleted as specified in the "Privacy Policy".

8. DISPUTE RESOLUTION

8.1. All disputes shall first be attempted to be resolved through direct negotiation.

8.2. If negotiations fail, disputes shall be resolved in accordance with applicable jurisdiction as determined by mandatory provisions of applicable law.

8.3. Applicable Law: This Agreement is governed by applicable law as determined by mandatory legal provisions, including consumer protection and data protection laws. Nothing in this Agreement limits your mandatory rights granted by the laws of your country of residence or applicable GDPR provisions.

9. AMENDMENTS

9.1. The Owner may update these terms with 30 days' advance notice via the Service's information platforms.

APPENDIX A: TECHNICAL REQUIREMENTS

A.1. Supported Formats: MP3, WAV, MP4. Other formats are not supported.

A.2. File Size Limits:

  • Guests: Up to 100 MB.
  • Standard: Up to 200 MB.
  • Pro: Up to 350 MB.
  • Freedom: Up to 350 MB.

A.3. Recommended Duration: For optimal results, uploaded files should not exceed 120 minutes.

A.4. Supported Languages: English, Russian.
